Plaintiffs in three suits accusing Allergan of failing to disclose a link between its Biocell breast implants and a rare form of cancer want their cases consolidated in Tennessee district court.
Allergan’s Biocell breast implant use a textured design that scientists have linked to a form of non-Hodgkin’s lymphoma called breast implant-associated anaplastic large cell lymphoma (BIA-ALCL).
European regulators banned the implants in December 2018 after health and safety concerns began to mount, but Allergan continued to sell its Biocell implants in the United States, said a complaint filed by two plaintiffs in New York.
Allergan issued a nationwide recall of Biocell breast implants In July 2019, after the U.S. Food and Drug Administration sent out a press release warning consumers about the link between the implants and BIA-ALCL.
As of July 2019, 481 of the 573 cases of BIA-ALCL reported worldwide were associated with Allergan’s BIOCELL implants, according to the FDA.
Lawsuits were filed against Allergan by women implanted with the company’s textured implants after the nationwide recall. The lawsuits allege Allergan failed to warn consumers about the potential safety risks of their implants and fraudulently concealed those risks, among other allegations.
In an Oct. 3 petition to the Judicial Panel on Multidistrict Litigation, plaintiffs said tens of thousands of women in the U.S. could be affected by the Allergan recall. There are currently five separate class actions pending in district courts across the country, including California, New York, New Jersey, Illinois, and Tennessee.
Plaintiffs want to see their cases consolidated in Tennessee because there are currently no pending MDLs in the state’s Central district.
The cases are IN RE: Allergan Biocell Textured Breast Implant Products Liability Litigation (MDL 2921) and Jane Doe 1 and Jane Doe 2 et al vs. Allergan et al (Case No. 7:19-cv-09151) in the District Court for the Southern District of New York.
